Terms of Service

These terms are between Viktr and the business using it. The short version: you are responsible for the consent behind every number you enrol and for every message you approve; we are responsible for not sending anything you have not approved, and for keeping your guests' data separate from every other shop's.
1. The agreement
By creating an account you agree to these terms on behalf of the business you represent, and you confirm you are authorised to do so. If you do not agree, do not use the service. “We” means Viktr; “you” means the business.
2. What the service does
Viktr enrols your customers in a loyalty programme by mobile number, tracks their visits and points, drafts SMS campaigns from your own visit patterns, sends the ones you approve, and turns a menu PDF into a page your guests can read.
Nothing sends without your approval. That is a property of how the product is built, not a setting: a campaign has to pass through an approved state that only a signed-in human can write, and the send path refuses anything that has not. We will not change this without telling you first.
3. Consent is yours to obtain
This is the clause that matters most. Under CASL you must have express consent before sending a commercial electronic message, and Viktr collects that consent at the moment of enrolment, through the wording on the join screen. You are responsible for making sure that:
- Every number you enrol belongs to someone who agreed to hear from you.
- You never import, paste or type in a list of numbers that did not come through the enrolment flow.
- Your staff do not enter a number on a guest’s behalf without asking them first.
Penalties under CASL are levied against the sender. If a complaint or penalty arises from numbers you supplied or consent you did not have, that is yours, and you agree to cover our costs if we are drawn into it.
4. What you may not send
Do not use Viktr to send messages that are:
- Unlawful, misleading, harassing, or discriminatory.
- About anything other than your own business.
- Regulated in ways SMS cannot carry safely — lending, gambling, cannabis, adult content, or health claims.
- Promising a reward you have not configured and cannot honour.
Our SMS carrier applies its own rules on top of these, and can suspend a number without warning if messages are reported as spam. We may suspend an account immediately for anything in this section, and will tell you why.
5. Your account
Sign-in is through Google. Keep that account secure; anything done from a signed-in session is treated as done by you. Tell us at once if you think someone else has access.
6. Your phone number
We provision a dedicated number for your shop so your messages come from you and a guest replying STOP reaches the right business. The number is allocated to your account for as long as it is active. It is not portable: if you close your account the number is released, and we cannot transfer it to another provider.
7. Menus
When you upload a menu PDF we read it with an automated system and store the items and prices it finds. The PDF itself is not retained. Automated reading is imperfect — check every line before publishing, because the published menu is your representation to your customers about price, and it is yours to get right. You confirm you have the right to publish the content you upload.
8. Drafted messages
Campaign text is generated by an automated system from your shop profile and your own visit patterns. It can be wrong, awkward, or wrong about your business. You are the editor and the approver; once you approve a message it is your message.
9. Your data
Your guest records and visit history are yours. We process them to run the service described here and for nothing else. You can export or delete them at any time. When you close your account we delete your guest data within 90 days, except opt-out records, which we keep permanently so a number that asked not to be messaged is never messaged again.
10. Fees
Subscription pricing, billing intervals and any message-volume charges are as published at the time you subscribe. Fees are billed in advance and are non-refundable except where required by law. We will give at least 30 days’ notice before a price change. You can cancel at any time, effective at the end of the period you have paid for.
11. Availability
We do not promise uninterrupted service. Viktr depends on third parties — an SMS carrier, a database host, a model provider — and any of them can fail. We will make reasonable efforts to keep the service running and to tell you when it is not.
12. Liability
The service is provided as is. To the fullest extent the law allows, we are not liable for lost profits, lost business, or indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the twelve months before it arose. Nothing here limits liability that cannot lawfully be limited.
13. Ending it
You can close your account at any time from the dashboard. We can suspend or close an account for a breach of these terms, for non-payment, or if required by a provider or by law. Sections 3, 9, 12 and 14 survive.
14. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, and the courts there have exclusive jurisdiction.
15. Changes
We may change these terms. Material changes are emailed to account holders at least 30 days before they take effect. Continuing to use Viktr after that is acceptance.
